4. Subscription Plans and Payment

Free Trial

You represent and warrant that:

• You own or have the right to use all User Content
• Your User Content doesn't infringe any third-party rights
• Your User Content complies with all applicable laws
• Your User Content doesn't contain sensitive personal information unless properly secured

AI-Generated Content

Content generated by our AI services is provided as-is. You are responsible for reviewing and verifying any AI-generated content before use. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated responses.

7. Intellectual Property

Our Property

The Services, including all software, text, images, and other content, are owned by Tedigo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Feedback

Any feedback, suggestions, or ideas you provide about our Services become our property, and we may use them without compensation or attribution.

8. Third-Party Services

Our Services integrate with third-party services, including OpenAI for language processing and Cloudflare for storage. Your use of these integrations is subject to the respective third-party terms and policies. We are not responsible for third-party services' availability, functionality, or content.

9. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our Services, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Limitations

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEDIGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free operation of our Services. We may modify, suspend, or discontinue any part of the Services at any time.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tedigo, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

You may terminate your account at any time through your account settings. Termination does not entitle you to any refunds for unused subscription periods.

Effect of Termination

Upon termination, your right to use the Services ceases immediately. We may delete your data after a reasonable retention period, subject to legal requirements.

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

Arbitration
